These Terms of Service ("Terms") are a binding agreement between you and BackBonePhD ("BackBonePhD," "we," "us," or "our") and govern your access to and use of PushBackIQ, available at pushbackiq.com and related pages (the "Service").
Please read these Terms carefully. They include an arbitration agreement and a class action waiver (Section 15) that affect how disputes are resolved, and they limit our liability (Sections 13 and 14). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are

2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and that you have the legal capacity to enter into these Terms. The Service is not directed to children, and we do not knowingly permit anyone under 18 to use it.
3. What the Service does
PushBackIQ is an AI powered tool that helps you decide what to say in personal, work, dating, or family situations. You describe a situation, and the Service uses third party artificial intelligence to generate suggested replies in different tones that you can review, edit, and copy. The Service does not send messages for you, act on your behalf, or communicate with any other person.
The Service is currently offered free of charge and may be supported by sponsors. We may add, change, limit, or remove features at any time.
4. Not professional advice
The Service provides AI generated suggestions for general informational purposes only. The suggestions are not legal, medical, psychological, therapeutic, financial, safety, or other professional advice, and they are not a substitute for advice from a qualified professional. Using the Service does not create any professional, advisory, counseling, or fiduciary relationship between you and BackBonePhD.
You are solely responsible for evaluating any suggestion and for anything you say or do based on it. Outcomes depend on facts we do not know and cannot control. If you are dealing with a serious matter, including anything involving your health, legal rights, or safety, consult a qualified professional. If you or someone else is in immediate danger, contact your local emergency services.
5. Acceptable use
You agree not to use the Service to:
- Break any law or regulation, or infringe anyone's rights.
- Harass, threaten, stalk, defame, abuse, or harm another person, or plan or encourage any of these.
- Generate or seek content that promotes violence, self harm, or the abuse or endangerment of a child, or that is otherwise harmful or illegal.
- Submit another person's personal or confidential information without a lawful basis.
- Attempt to reverse engineer, scrape, overload, disrupt, probe, or bypass the security, rate limits, or bot protection of the Service, including Cloudflare Turnstile.
- Use bots, automation, or scripts to access the Service, except as we expressly permit.
- Resell, sublicense, or commercially exploit the Service or its outputs without our written permission.
- Misrepresent AI generated content as human generated in a way that is deceptive or unlawful.
We may investigate and take action, including limiting or blocking access, for any suspected violation.
6. Your content
"Your Content" means the scenario text and other input you submit to the Service. You keep any rights you have in Your Content. You represent that you have the right to submit it and that doing so does not violate any law or third party right.
You grant us a limited, non exclusive, worldwide, royalty free license to use, process, and transmit Your Content to third party AI and infrastructure providers for the sole purpose of operating the Service and generating your requested reply. This license exists only to run the Service. As described in our Privacy Policy, we do not store your chat logs and we do not use Your Content to train AI models.
Please do not submit more sensitive or confidential information than necessary. See our Privacy Policy for how we handle information.
7. AI outputs
"Outputs" means the replies and other content the Service generates for you. As between you and us, and to the extent permitted by law, we do not claim ownership of the Outputs you receive, and you may use them for your personal, lawful purposes.
You understand that:
- Outputs are generated by AI and may be inaccurate, incomplete, outdated, biased, or inappropriate for your situation.
- Outputs are not guaranteed to be unique, and similar Outputs may be provided to other users.
- You are responsible for reviewing Outputs before relying on or acting on them.
- We make no representation that Outputs are suitable for any particular purpose.
8. Intellectual property
The Service, including its software, design, text, graphics, logos, and the PushBackIQ and ProjectPinkOwl names and marks, is owned by BackBonePhD or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non exclusive, non transferable, revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.
9. Third party services, providers, and sponsors
The Service relies on third party providers, including Cloudflare (hosting, security, Turnstile, and AI gateway), AI infrastructure providers, and AI model providers such as OpenAI, Google, and Anthropic (Claude). The Service may also display sponsor placements and links to third party websites.
We do not control third party services or sites, and we are not responsible for their content, products, availability, or practices. Your use of a third party service or site is governed by that party's own terms and policies. Sponsorship or a link does not mean we endorse a third party.
10. Privacy
Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.
11. Availability and changes to the Service
We provide the Service on an "as available" basis. We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Service.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Service and all Outputs are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non infringement.
We do not warrant that the Service will be uninterrupted, secure, error free, or free of harmful components, or that any Output will be accurate, reliable, or suitable for your needs. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, BackBonePhD and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service or any Output, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us to use the Service in the 12 months before the claim, or fifty US dollars (US $50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless BackBonePhD and its members, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third party right.
15. Dispute resolution, arbitration, and class action waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at hello@pushbackiq.com and give us 30 days to try to resolve the dispute informally.
Binding arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court.
Class action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.
Your right to opt out. You may opt out of this arbitration agreement by emailing hello@pushbackiq.com within 30 days of first accepting these Terms, stating your intent to opt out. If you opt out, the governing law and venue in Section 16 apply to disputes.
This section does not apply where it is prohibited by law.
16. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Subject to Section 15, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Nothing in this section limits any mandatory consumer protections available to you under the laws of the place where you live.
17. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination, including Sections 4 and 6 through 18, will survive.
18. General terms
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Changes to these Terms. We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice through the Service. Your continued use of the Service after changes take effect means you accept the revised Terms.
- Severability. If any provision is found unenforceable, the rest of these Terms remain in effect, and the unenforceable provision will be limited or removed to the minimum extent necessary.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No third party beneficiaries. These Terms do not create any third party beneficiary rights.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Relationship. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and us.
